OnGuard ACEPro Privacy Policy Statement -

As of
1 March 2009, OnGuard Safety Training Pty Ltd updated its OnGuard ACEPro
privacy policy to give our customers a better understanding of our OnGuard
ACEPro privacy policy and practice. If you have any questions, please

OnGuard
Safety Training Pty Ltd and our affiliated companies worldwide are committed
to respecting online privacy and recognize the need for appropriate
protection and management of any personally identifiable information
(personal information) or sensitive information. This information
will be offered at the initial program login phase.
An
individual
user can share this
information with us
or
the
education provider will share this information on the individual users
behalf.
OnGuard Safety Training Pty
Ltd has established this OnGuard ACEPro privacy policy so that you can
understand the care with which we intend to treat your personal and/or
sensitive information.
Personal information means
any information that may be used to identify an individual including, but
not limited to:

a first and family
name,

a home or other
physical address,
-
an e-mail address
or other contact information,
-
date of birth
-
name of parents
-
whether at work or
at home.
In general, the new user
will not be able to login to the OnGuard ACEPro Safety Training Program
without revealing an aspect of personal information - namely first name,
family (last) name and year group.

If the user chooses or their
education provider chooses to provide us with this personal information, we
may transfer that information within OnGuard Safety Training Pty Ltd on our
servers, for the purpose of data maintenance only.
At this time we are aware that legislation
may differ considerably between the states of Australia.

The education provider will need to seek
legal advice in this matter. For instance Principal's may be required to request
the release of student information from their relevant education authority.

At the very least, under-age individual users
may require permission to release information from a parent and/or
caregiver. (see

OnGuard Safety Training Pty
Ltd strives to comply with all applicable Privacy laws that are designed to
protect a user's privacy. Although legal requirements may vary
from state to state and country to country, OnGuard Safety Training Pty Ltd
intends to adhere to the principles set forth in this OnGuard ACEPro Privacy
Policy even if, in connection with the above, we transfer personal
information from your country to countries that may not require an
'adequate' level of protection for personal information. In other words, our
goal is to provide protection for personal information no matter where that
personal information is collected, transferred or retained.
Cookies and other tracking technologies
Some of our online training
pages may utilize 'cookies' and other tracking technologies. A cookie is a
small text file that may be used, for example, to collect information about
website activity. Some cookies and other technologies may serve to recall
personal information previously indicated by a web user. Most browsers allow
the user to control cookies, including whether or not to accept them and how
to remove them.
M ost
browsers can be set to notify the user if they receive a cookie or they may
choose to block cookies with the browser. Please note if cookies are
erased or blocked, the user will be required to re-enter the original user
ID and password to gain access to the OnGuard ACEPro Safety Training
Program.
Tracking technologies may
record information such as internet domain and host names, internet protocol
(IP) addresses, browser software and operating system types, click-stream
patterns, and dates and times that our site is accessed. Our use of cookies
and other tracking technologies allows us to improve our product and your
training experience. We may also analyze information that does not contain
personal information for trends and statistics.
To protect the privacy of
our users, we have adopted the following principles.
Notice
OnGuard Safety Training Pty
Ltd does not intend to transfer personal information without a user's
consent.
Choice
The user
may choose
whether or not to provide personal information to access and login to the
OnGuard ACEPro Safety Training Program. If the user chooses not to provide
personal information such as first name and family name, the user will not
be able to produce meaningful certificates of attainment, developed by the
OnGuard ACEPro Safety Training Program. As an alternative, the education
provider can choose to initiate a system of 'alias' login details, and
configure the program so that there is no need to provide personal
information at all. The education provider would be required to keep a
record of 'alias' identities, for the administrative purposes of teaching
staff.
Security
Wherever personal
information may be held within OnGuard Safety Training Pty Ltd or on its
behalf, we intend to take reasonable and appropriate steps to protect the
personal information that you share with us from unauthorized access or
disclosure. We are committed to protecting the security of personal
information. We use a variety of security technologies and procedures to
help protect personal information from unauthorized access, use, or
disclosure, such as encryption, passwords, physical security, etc. While we
strive to protect personal information, we cannot ensure or warrant that the
personal information or private communications transmitted to us will always
remain private, and you do so at your own risk. We choose NetRegistry for our web services. Their data centre
maintains the highest level of building security around the clock. The
centre's multiple CCTV points, secure entries and exits and limited access
areas are all managed by building control staff 24x7. The right to privacy
and data security is a primary concern. That's why, when a user logs in to
OnGuard ACEPro, we help them to maintain control over their personal data. A
password is used to help protect a user's account and personal information,
it is the user's responsibility to keep the password confidential. Do not
share this information with anyone. If a security-enabled browser (such as
Microsoft Internet Explorer version 2.1 or greater, or Netscape Navigator
version 2.0 or greater) is being used, the information sent is encrypted,
making it extremely difficult to read even if it is wrongly intercepted.
Access
To the extent that the user
does provide us with personal information, OnGuard Safety Training Pty Ltd
wishes to maintain a high level of security to access to personal
information. Each education provider has a dedicated database which has a
specific URL and is password protected. The education provider's 'system
administrator' is the only person who can deploy, distribute, configure and
manage the information held in the database. This
'system administrator' can
however, add users with limited management rights. These are most usually
the teaching staff using the training program.
A very limited number of staff at
OnGuard Safety Training Pty Ltd have administrator rights to access the web
server deploying the OnGuard ACEPro safety training program, and therefore,
can access personal information held in the databases managed by education
providers. The persons in the company that have this level of access include
the company Director, the program developer and the program interface
designer.
Third-party services
Third-parties provide
certain services available on OnGuard Safety Training Pty Ltd's behalf.
Service providers are also an important means by which OnGuard Safety
Training Pty Ltd maintains its client web servers. OnGuard Safety Training
Pty Ltd will take reasonable steps to ensure that these third-party service
providers are obligated to protect personal information on OnGuard Safety
Training Pty Ltd's behalf.
Children's privacy and confidentiality
OnGuard Safety Training Pty
Ltd's safety training program is designed to be used by school age children,
as well as adults. Accordingly, the login process does collect personal
information from children of school age and we are committed to ensure that
the individual privacy of each child is respected and not passed on to any
third-party for any reason whatsoever. Note: the
education provider's 'system
administrator' can configure the OnGuard ACEPro program to hide the first
name and family name data fields from the self enrol page. In this case, no
personal or sensitive data is written back to the education provider's
database for any child or adult user.

Commitment
We are committed to privacy
and support current industry initiatives to preserve individual privacy
rights on the internet. Protecting your privacy online is an evolving area,
and OnGuard Safety Training Pty Ltd's online training programs are
constantly evolving to meet these demands.

Your consent
By subscribing to and using
the OnGuard ACEPro Safety Training program, the education provider or
individual user consents to the terms of our OnGuard ACEPro privacy policy
and to OnGuard Safety Training Pty Ltd's maintaining personal information of
users on its web server.
Changes to this OnGuard ACEPro privacy policy
Should the OnGuard ACEPro
privacy policy change, we intend to take every reasonable step to ensure that
these changes are brought to the attention of users by posting all changes
prominently on our program in a timely fashion.
